In Russia, regarding foreign employees included in the registry of controlled persons (RKL), employers have the right to temporarily suspend them from work instead of immediate dismissal. This approach is considered the most optimal way to regulate labor relations.
At a seminar for entrepreneurs organized by the "Opora Rossii" organization, lawyer Vladislav Shalaginov provided explanations regarding this procedure. According to him, if an employee is included in the registry, the employer must suspend them from performing their job duties and formalize this process with a separate order.
This period of temporary suspension provides the employee and the employer with an opportunity to determine the reasons for inclusion in the registry and to regulate their legal status. This method allows the employer to avoid violating migration legislation and not to terminate the employment contract with the employee immediately.
Experts view this step as an additional opportunity for migrants to legally restore their status and retain their jobs.
