The Ministry of Internal Affairs of Russia has provided an important clarification regarding the procedure for the use of labor patents by foreign citizens. According to it, when a foreign worker is dismissed, their patent is not automatically cancelled. This situation allows the migrant to sign a new employment contract with another employer before the patent's expiration date.
However, to exercise this right, migrants must comply with a number of obligations. First and foremost, it is necessary to continue making timely payments for the patent. Also, work must be carried out only in the region specified in the patent, and if a profession is defined in the patent, it must be strictly in that specialty.
According to the legislation, employers must also act in the prescribed manner. The new employer is required to notify the Russian Interior Ministry within three working days after the contract is signed with the foreign citizen. Similarly, the former employer must also provide information to the relevant authority about the employee's dismissal within three working days.
