What to do if a patent payment is sent to the wrong details?

In Russia, an error in the details when paying for a work patent can lead to serious consequences for a foreign worker. Even if the money has been debited from a bank card, if the funds were transferred using incorrect details (KBK, OKTMO, full name, or INN), the patent is considered unpaid. In such a case, there is a risk of patent cancellation, fines, as well as deportation and a ban on entry into Russia.

First of all, you need to clarify the status of the transaction with the bank and obtain an extended payment confirmation in PDF format. A regular receipt or screenshot may not be sufficient evidence for the tax office. After that, you need to contact the Federal Tax Service (FNS) of Russia branch at your place of residence and submit an application to clarify or refund the payment. According to Article 78 of the Tax Code, an application for clarification or refund of a payment can be submitted within three years from the date of payment.

If the patent's validity period is expiring, it is recommended not to wait for the erroneous payment to be returned, but to make a repeat payment with the correct details. This will protect the patent from being cancelled. The first payment can later be refunded through the tax office or credited against other taxes.

When explaining the situation to your employer, it is necessary to provide not only the receipt but also copies of inquiries made to the bank and the tax office, the type of error identified, and a plan to resolve the issue. This reduces the risk of the employer suspending the employee from work. Remember that timely and correct payment for the patent is the main condition for your legal employment.
